After a lengthy and arduous legal fight, global sensation Beyoncé Knowles has finally emerged victorious in her quest to trademark her 12-year-old daughter Blue Ivy’s name.
According to The Trademark Official Gazette, Beyoncé won her legal challenge against a small Wisconsin boutique that had owned the trademark since September 2009 for the phrase ‘Blue Ivy’.
The legal battle began in early 2012, shortly after the birth of Blue Ivy, when Beyoncé’s company, BGK Trademark Holdings LLC, filed an application with the United States Patent and Trademark Office. However, the application was met with opposition from wedding planner Veronica Morales, who claimed that her company, Blue Ivy Events, had been operating under the name since 2009.
Despite the opposition, the USPTO dismissed Morales’ concerns in 2020, citing that the event planning company and Beyoncé’s daughter’s name were not sufficiently similar. However, Beyoncé’s attorneys failed to pursue the paperwork for ‘Blue Ivy’, resulting in its abandonment at the time.
Undeterred, Beyoncé filed for the trademark of Blue Ivy’s name once again in November 2023, but a tentative issue was raised since a Wisconsin boutique had the Blue Ivy emblem. The examiner claimed that the store, which has owned the brand since 2011, and the star’s daughter’s name were ‘confusingly similar’.
According to the document, “Within 30 days of the publication date, any party who believes it will be damaged by the registration of the mark may file a notice of opposition (or extension of time) with the Trademark Trial and Appeal Board.” This means that if no refusals are filed by January 30, Beyoncé’s attorneys will receive a Notice of Allowance.
Beyoncé’s husband, rapper Jay-Z, explained the reason behind filing the trademark in a 2013 interview with Vanity Fair. “People wanted to make products based on our child’s name, and you don’t want anybody trying to benefit off your baby’s name,” he said. “It wasn’t for us to do anything; as you see, we haven’t done anything.”
With the legal battle finally over, Beyoncé can now proceed with trademarking her daughter’s name, ensuring that no one else can profit from it. The news comes as Beyoncé recently announced that she is working on a new project, which has sent her fans into a frenzy.
