A Lagos High Court has delivered its ruling on the legal application brought by the father of the late singer, Mohbad, over the handling of his son’s case.
The Lagos State High Court sitting in Ikeja has dismissed an application filed by Mr. Joseph Aloba, father of the late singer Ilerioluwa Aloba, popularly known as Mohbad, seeking to overturn the legal advice issued by the Director of Public Prosecutions (DPP) that led to the release of Naira Marley, Sam Larry, and others previously suspected of involvement in his son’s death.
Delivering the ruling on Wednesday, July 2, 2025, Justice Taiwo Olatokun held that the Lagos State Attorney General exercised lawful authority in deciding whether to prosecute the suspects based on available evidence. The judge further ruled that the reliefs sought by Mr. Aloba could not be granted, as the Attorney General’s prosecutorial powers, through the DPP, are not subject to challenge in this context.
Reports that the ruling was met with disappointment from Mr. Aloba and several supporters of the late singer who were present in court.
While the DPP’s legal representatives declined to comment after the verdict, Wahab Shittu (SAN), counsel to Mr. Aloba, revealed that his client would be appealing the decision.
In the suit, filed by Mr. Aloba on behalf of the Aloba family, the respondents were the DPP and the Lagos State Attorney General. Aloba’s legal team had argued that the DPP’s decision to release the suspects pre-empted the outcome of the ongoing Coroner’s Inquest, which is still investigating the circumstances surrounding Mohbad’s death. They claimed that individuals mentioned in the inquest proceedings were prematurely discharged by the legal advice.
Responding through a counter-affidavit submitted on June 24, a legal assistant in the DPP’s office, Ayinde Ibrahim, maintained that the suspects were not acquitted but merely discharged based on a lack of evidence linking them to Mohbad’s death. The DPP’s office also explained the legal process that informed its decision, noting that no facts were disclosed during investigations directly implicating Naira Marley, Sam Larry, Prime Boy, or Opere Babatunde in the singer’s death.
The court ultimately upheld the DPP’s position and dismissed the application and case of the father of late Mohbad in the interest of justice.
