The Lagos State High Court in Ikeja has scheduled July 2, 2025, to deliver judgment in a case filed by Mr. Joseph Aloba, father of the late singer Ilerioluwa Aloba, popularly known as Mohbad.
The suit challenges the legal advice that cleared music stars Naira Marley and Sam Larry of any alleged involvement in the singer’s death.
Justice Taiwo Olatokun fixed the date after hearing arguments from legal representatives on both sides. Mr. Aloba, represented by Senior Advocate of Nigeria Wahab Shittu, filed the case on behalf of the Aloba family against the Lagos State Attorney General and the Director of Public Prosecution (DPP).
Shittu argued that the legal advice issued by the DPP prematurely influenced the ongoing coroner’s inquest into Mohbad’s death and denied the family a fair hearing. He expressed concern that suspects mentioned during the inquest were released based on this advice, even though the inquest had not concluded.
Responding through a counter-affidavit, Ayinde Ibrahim, a legal officer in the DPP’s office, clarified that those released were discharged, not acquitted. The DPP maintained it acted within its legal authority after reviewing the police investigation file and insisted that neither the applicant nor the Coroner had access to the full casefile at the time.
The DPP further stated that there was no credible evidence linking Naira Marley, Sam Larry, or other named individuals to Mohbad’s death. “A thorough legal review revealed no facts connecting them directly or indirectly to the death,” the affidavit noted.
Additionally, the respondents argued that Mr. Aloba failed to present new evidence or independent investigative findings that could justify overturning the DPP’s decision. The court is expected to rule on the case of whether to uphold or set aside the legal advice and determine its effect on the broader legal proceedings surrounding the death of Mohbad on July 2.
